Texas regulators are fast-tracking permits for gas-burning power plants that will serve AI data centers, approving some in as little as two days and without public notice. The approvals come as President Trump has launched a historic weakening of environmental protections dating back more than a half-century.

In March, a developer working on a Meta data center in El Paso applied to power the site with a gas-burning plant large enough to supply electricity to 300,000 homes. Typically, approving a big power plant might require public hearings and months of detailed vetting, but Texas environmental regulators signed off in just 20 days. They approved another project in three days, and an even larger data center power plant, also gas-burning, won approval in just two days. All without public notice.

In the US, securing permits for a new-build data center typically takes 6 to 18 months, though some projects, including one in Virginia, have waited more than two years for approvals. Much of the variation comes down to local conditions and project specifics, including local zoning laws, environmental impact, community review, and site conditions. On-site fossil fuel generation often requires air permits.

Some states and the federal government have moved to streamline approvals for certain infrastructure projects, including data centers. The White House issued a directive to this effect in July 2025, and governments in states like Pennsylvania have incentivized data center development. At the same time, other states — such as New York, Minnesota, and Maine — have explored policies that could slow or pause new data center development, though many of these measures are still proposals rather than enacted law.

Regulators are tightening scrutiny of water consumption, backup generator emissions, and air quality impacts. Several jurisdictions are tightening permitting for multi-MW generator banks, with permittees considering factors traditionally associated with Clean Air Act major source-style analyses (e.g., best available control technology, lowest achievable air emission rate, dispersion, and health-risk modeling), even when generator banks are classified as "emergency." Some regulators are promoting transitions to batteries, fuel cells, and hydrogen-ready systems. Permits increasingly condition approval on direct-to-chip or immersion liquid cooling, PFAS-free chemistries, and heat-reuse tie-ins.

In water-scarce basins, regulators are insisting on increased water usage efficiency, non-potable supplies, and drought-contingent operating plans. Water usage effectiveness (WUE) is emerging as a tracked metric alongside power use effectiveness (PUE), with formal targets, third-party assurance, and public reporting. Some utilities have also implemented systems imposing tiered pricing and surcharges.

Diesel generator fleets present two converging risks — regulatory classification creep and community exposure. In some jurisdictions, community-wide diesel risk assessments are informing permit thresholds and conditions. For example, in connection with diesel backup power generation for a data center in Quincy, Washington, regulators required a community-wide diesel health risk assessment.

There is no guaranteed fast track, but several strategies can reduce friction and shorten timelines: choosing jurisdictions with prior experience, submitting complete plans, addressing environmental requirements from the start, and starting with a simpler initial build before adding complex elements. Some organizations have attempted to avoid scrutiny by downplaying or omitting the term "data center" in related permit filings, but this tactic is increasingly ineffective.
